Terms & Conditions of Booking

These terms and conditions apply to the booking made between Blue Hayes Private Hotel (Blue Hayes) and the person from whom the booking has been accepted (you / the Guest). You, the Guest, confirm your acceptance of these terms and conditions on confirmation of a booking.

Bookings

A non-refundable Deposit of £200.00 is charged once the booking has been accepted by Blue Hayes and you have received a confirmation email.

One night bookings are only accepted where the preceding night and the following night are already booked, and need to be paid in full at the time of booking.

Single Occupancy

Single occupancy of any double room benefits from a £60 reduction of the room rate per night shown in the tariff.

Children & Pets

Blue Hayes is unable to accommodate children below the age of ten years. A child between the ages of ten to fifteen years old (sharing the Godrevy Suite with two adults) is charged at £130.00 per night Room & Breakfast.

Any child under the age of sixteen years must be properly supervised at all times and remain the sole responsibility of the supervising adult(s) at all times. The supervising adult(s) shall be liable for any loss or damage or incurred as a consequence of any failure to supervise, as determined by Blue Hayes.

If children arrive at Blue Hayes without proper supervision then Blue Hayes reserves the right to refuse them access, at its sole discretion, until such time as Blue Hayes considers proper supervision has been provided.

Blue Hayes does not have any facilities to accommodate pets.

Non-Smoking

Blue Hayes is a totally non-smoking establishment, and this policy extends to all areas and all rooms including bedrooms, terraces and balconies. All Guests are respectfully requested to observe this condition, and Blue Hayes reserves the right to terminate this contract forthwith and require any Guests that disregard this policy to leave the premises immediately on settlement of any bills due and payable.

Without prejudice to the aforementioned, when entering into this contract, you specifically accept liability for any loss, damage, cost or expense caused to Blue Hayes or to any persons or property through smoking on any part of Blue Hayes

Arrival & Departure

All reservations shall be effective from 3.00pm on the day of arrival, and every effort will be made to have rooms ready for occupation by that time, but Blue Hayes does not guarantee your check-in time. Guests shall vacate their room by 11.00am on the day of departure, otherwise a further full day’s rate may be charged.

Rooms

All bedrooms have direct dial telephone, WIFI and Internet access point, tea and coffee making facilities, small milk fridge, colour television, radio, hair dryer, and cooling fan.

Breakfast

Breakfast is served in the Dining Room or on the Terrace (weather permitting) from 8.30am until 10.00am. Vegetarian dishes are included within the menu. Special diets can be catered for, subject to reasonable prior notification.

Light Suppers

Light Suppers can be served in the Dining Room or on the Terrace (weather permitting) from 6.30pm until 7.30pm., but are only available reasonable notice with an advance order. Orders need to be placed at breakfast time on the day required or earlier. If you wish to order a Light Supper for the evening of your arrival, please place your order by telephone or email the day before arrival.

Cocktail Bar

Blue Hayes is licensed to sell wines, spirits and beers.

Car Parking

Car parking is provided free for Guests in the car park at the front of the premises, and you confirm that Blue Hayes shall have no liability or responsibility for any damage or loss, cost or theft of any parked vehicles or their contents, and you accept full responsibility for your vehicle and its contents at all times.

Access & Mobility

Blue Hayes is built on a hillside, and comprises five levels, with steps between each level. We do not have a lift. As such, the premises are unfortunately unsuitable for wheelchair users or guests with mobility difficulties. As a consequence, you / the Guest waive your rights in full under the Disability Discrimination Act 1992 or any successive or related statutory instrument.

Special Needs

Please advise any special needs of anyone in the party prior to or at the time of booking. Should there be anything you feel Blue Hayes should be made aware of in order to ensure your comfort and safety whilst you are with us, please do not hesitate to inform us with complete information regarding your special requirements.

Cancellation

Twenty-eight days’ notice of a cancellation of booking is required. Deposits are non-refundable in the event of cancellation. Blue Hayes will make all reasonable efforts to re-let the accommodation, but if this fails, the Guest will be liable for an amount equal to two-thirds of the booking value. We strongly recommend you insure against the possibility of cancellation.

Blue Hayes reserves the right at its sole discretion to cancel a booking forthwith and without any liability on its part in the event of any cause beyond its control which prevents it from performing its obligations relating to any booking, and will refund the Deposit in full and have no further liability for any cost or expense incurred by you, the Guest, as a consequence of any cancellation.

Payments

Cheques are accepted for payment of the booking value in full, only if received at least seven days in advance of the arrival date. Debit Cards and the following credit cards are accepted: Mastercard, Visa, Visa Debit and American Express.

Loss From or Damage to Hotel Property

The Guest agree to fully indemnify Blue Hayes for any loss, cost or damage to Blue Hayes property or the furnishings and equipment therein caused by any act or default, on your part, your guests or any contractor or agent brought on to the premises. You agree to pay to Blue Hayes on demand the amount required to make good or remedy the damage, loss, cost or expense or replace or reimburse the full replacement values of any items missing from Blue Hayes. If in the opinion of the proprietor of Blue Hayes any Guest is not suitable to remain on the premises because of unreasonable behaviour, damage (actual or potential) or nuisance to other parties, the Guest shall be asked to leave and also vacate their room, settle all billing due and payable, and no refund shall be due.

Loss From or Damage to Guest’s Property

Whilst every effort is made to safeguard Guests’ property, Blue Hayes does not accept responsibility for loss of or damage to any cash, money, jewellery or other articles of value.

In the event of negligence on the part of Blue Hayes which gives rise to loss of or damage to property belonging to a Guest then Blue Hayes’ limit of liability will be limited to £50 for any single article and subject to a total of £100 in the case of any one person. No liability is accepted for any consequential loss arising from loss or damage to any property of the Guest. Blue Hayes does not accept responsibility for loss of or damage to motor cars or other vehicles of any kind, or any property lost in them. Blue Hayes refers to and relies upon The Hotel Proprietors Act 1956.

Guest’s Duty to Take Care

All Guests are required to take reasonable care to avoid accident or injury at all times whilst on the premises but extra care should be taken when in Blue Hayes’ gardens and especially when using the granite steps and all areas which are hazardous when wet.

No Candles or Nightlights

The use of candles, night lights or any other device incorporating a naked flame for the purpose of decoration or illumination is strictly prohibited anywhere on the premises. You, the Guest, accept full liability for any loss, cost or damage as a consequence of any such use.

General Points

No Guest shall arrange for the delivery of or deliver any goods or material to Blue Hayes without prior arrangement with Blue Hayes. No Guest shall store or place on the perimeter of or in Blue Hayes any inflammable, combustible or objectionable substances or liquid.

Waiver

The failure of Blue Hayes to enforce or exercise, at any time, or for any period of time, any term of, or any right pursuant to this Agreement does not constitute and shall not be construed as a waiver of such term or right.
